The H-1B lottery is a system used by the USCIS to select people eligible for an H1B visa. If you are new to the H1B visa application process, you may come across the H1B lottery. The H1B lottery is a random selection process.

The main objective of this lottery system is to select the total number of H1B applicants. The US Department of Treasury has increased the credit transaction limit of H1B visa holders to $39,999.99 per day. So, compared to FY 2022, the USCIS is introducing various types of changes.

Another purpose of the lottery selection is to select applicants to meet the H1B cap of 65000 applicants for the regular quota. For the master’s allocation, the H1B cap is 20000. The H1B lottery situation arises due to the fixed availability of the total number of H1B visa slots. After the completion of the lottery, the USCIS will announce the results on its website.

H-1B Lottery- Tactics to Prepare for the Procedure

You should begin the preparations for the lottery, as USCIS will receive registrations on March 1, 2023. Similar to the DV Lottery, you have to start by creating the USCIS online account. Your employer must submit a single registration per beneficiary sponsored by them.

The registration process includes providing the recipient’s data along with $10 non-refundable fees. On March 17, 2023, the registration window will shut down. For this visa, you should know about the permanent labor certification process.

On or before March 31, the authorities at the USCIS will alter the statuses to announce the selected candidates. If you’ve been selected, you should file requisitions and get them permitted to get the visa. If the USCIS accepts your petition, you can apply for the H-1B visa by April 1, 2023. The H-1B visa is only for skilled professionals like engineers, architects, doctors, researchers, etc.

H-1B Lottery- Submission Policies to be Aware of

The Chilean and Singaporean citizens have 6800 H-1B visas set aside because of the Free Trade Agreement. Note that there is a definite timeline for the lottery.

  • All registrations should be provided after noon EST on March 1.
  • Ensure to submit before noon EST on March 17.
  • The employers are eligible to give only one registration per beneficiary.

Here are the types of documents required for registration for the H-1B visa.

  • The employer’s FEIN, detailed address, contact, and their lawyer’s information.
  • The name of the beneficiary, home country, DOB, number of the passport, and sex.
  • The USCIS will also need the educational details of the beneficiary.

If you are unsure, consulting an attorney specializing in federal immigration law will be beneficial. By March 17, if the USCIS receives a large number of applications, they will randomly select beneficiaries. In 2023, you can expect the H-1B lottery results to be published in April’s first week.

Where should you Mail your H-1B Appeal after Getting Selected?

You should file the petition with the correct service center. The registration selection notice typically mentions the details of the service center. It is essential to consult with the USCIS address page to recognize the correct mailing address.

But how will you know that you’ve been chosen for the H-1B lottery? Here are the common statuses you will come across at the USCIS registration portal.

· Submitted

It implies that you’ve successfully submitted your application.

· Selected

The USCIS has selected your H-1B visa lottery registration. It is now up to your employer to file the 1-129 petition.

· Denied

As the name suggests, your registration has been denied. It only happens when the sponsor has submitted more than a single registration.

In the past H-1B seasons, the denial rates were low. However, you must prepare adequately while applying for the H-1B visa. Employers should collect and submit all the essential documents to get their beneficiaries selected at the H-1B lottery. The beneficiary has to maintain regular communication with their employer in the USA to address issues that may arise.
